Homelessness lawyers complain of legal aid 'culture of refusal', Law, The Guardian

Lawyers who help people in danger of losing their homes claim they are being forced to take on cases at their own financial risk as the Legal Aid Agency adopts a “culture of refusal”. Applications for legal aid in homelessness cases have tumbled despite a steep rise in the number of street sleepers over the past six years, the agency’s figures show. Some lawyers say they have to take cases on a pro bono or unpaid basis, hoping that legal aid will belatedly be awarded by the LAA to cover their costs. Concern over the way legal aid is awarded in homelessness cases was raised after a Birmingham woman, Terryann Samuels, won a case at the supreme court this month. The LAA repeatedly refused to...

Non-Lawyer Legal Professions, @WashULaw

Non-Lawyer Legal Professions If you work in a legal setting, it’s important to be able to research, document and communicate with the same accuracy and efficiency as a lawyer — but you don’t need to earn a full JD to do so. With a Master of Legal Studies (MLS), you’ll refine your skills in these areas and enhance your understanding of the U.S. legal system and its procedures so you can work more confidently and cultivate a better rapport with lawyers in your office. You can also gain specialized expertise in a particular area of law, such as health or employment law, by selecting electives in your area of interest. Professionals in non-lawyer legal professions who...

The Secret Barrister: 'Without legal aid, the rule of law collapses', Law, The Guardian

The Guardian asked the Secret Barrister, author of the bestselling book Stories of the Law and How It’s Broken, to answer candidly some questions on the criminal justice system: how it works and how, all too often, it doesn’t. How are the cuts in legal aid affecting people? In the criminal sphere, which is where I operate, legal aid cuts over the past decade have restricted access to funding in both the magistrates courts (where less serious offences are tried) and the crown court (dealing with serious offences, including those carrying up to life imprisonment). The impact is felt in several ways. Firstly, many people who are far from wealthy are deprived of funding altogether. Anyone with...

Different Types of Lawyers - Legal Reader

Law, like medicine, has generalists and specialists. It’s always a good idea to consult lawyers in the field pertaining to your case. Everyone seeking the assistance of a lawyer needs to visit a specialist for their case. One should be aware that there are many types of lawyers and not every lawyer has information regarding fields or have the expertise to practice all types of law. In layman’s terms, it is like visiting a doctor, where a general practitioner can provide basic assistance, but it is necessary to visit a specialist depending on the type of disease or injury. Visiting a lawyer involves many types of fees. There will be a consultation fee which would be charged on an...

Rise of the Robolawyers - The Atlantic

Beyond helping prepare cases, AI could also predict how they’ll hold up in court. Lex Machina, a company owned by LexisNexis, offers what it calls “moneyball lawyering.” It applies natural-language processing to millions of court decisions to find trends that can be used to a law firm’s advantage. For instance, the software can determine which judges tend to favor plaintiffs, summarize the legal strategies of opposing lawyers based on their case histories, and determine the arguments most likely to convince specific judges. A Miami-based company called Premonition goes one step further and promises to predict the winner of a case before it even goes to court, based on statistical analyses...

How legal aid cuts filled family courts with bewildered litigants, Law, The Guardian

It was every parent’s worst nightmare. Jane had less than four hours to avoid losing her child for ever. But no one knew which form she should fill in. A labyrinthine bureaucracy stood in her way. And she had no lawyer to help. Jane*, who is autistic, had that morning finished the parenting course ordered by the judge. She was now running around the rabbit warren that is the central family court in London. It was Friday afternoon. Once her child was adopted on Monday, she would never see him again. Jane’s was no isolated case. This is one way children are lost to their parents in the family courts. Legal aid cuts mean growing numbers of parents struggle alone, navigating a system designed...

Was Shakespeare "Sometimes Like a Lawyer"? Legal Writing With The Bard, Trademark and Copyright Law

William Shakespeare breathed his last on April 23rd, 1616, so this April 23rd marks 400 years since his death. It is also, supposedly, his 452nd birthday. Putting aside the oft-silly conspiracy theories and multitudinous alternate spellings of his name, many details of Shakesper’s life are clearly documented in contemporary sources. No one is sure, however, exactly what he was up to in the 1580s. One compelling theory suggests that he spent some part of that decade as a lawyer – or at least working for one. It’s hardly a foregone conclusion, but neither is it an improbable fiction. Because I wear my heart upon my sleeve, I’ll disclose up front that I’m a Shakespear devotee as well as...
