Steven Donziger outside the Court of Appeals in New York, April 2015 (Reuters: Mike Segar) Steven Donziger is going to have his day in court, again — this time as a criminal defendant. Donziger, the lawyer, Obama buddy, and climate activist who tried to extort a few billion dollars from Chevron, is the target of an order from district judge Lewis Kaplan, who has on his own authority appointed three lawyers to prosecute Donziger on criminal contempt charges. Donziger’s shakedown was, by my reckoning, the largest extortion attempt in human history, and the case involved everybody from activist rock stars such as Roger Waters to Democratic operatives such as Karen Hinton, sometime contributor...

The deputy of Islamic Republic judiciary in legal affairs has insisted that defense attorneys should respect the "public's rights", and avoid defending those accused of "espionage". The Islamic Republic often makes unsubstantiated accusations of espionage against activists or critics in order to justify their prosecution and bring about longer prison sentences. Speaking on Thursday, August 1, in the Western city of Hamadan, the mid-ranking cleric, Mohammad Mossaddeq warned attorneys, "If a lawyer accepted to defend a person accused of espionage, they should be reminded that, by doing so, they would ignore the rights of eighty million Iranians." Meanwhile, Mossaddeq asserted that...

Bear brouhaha: Can cops and conservation officers take your phone? Yes, says this lawyer Across B.C.'s lower mainland this summer, human-bear conflicts have risen to the point where some residents are deciding to take matters into their own hands. Earlier this week, three people were arrested north of Mundy Park in Coquitlam on charges of obstructing conservation officers as they attempted to deal with a family of bears habituated to humans and their garbage. Tony Faccin, who said he filmed part of the encounter before he was arrested, later had his phone confiscated by conservation officers under the suspicion that it contained evidence relating to the obstruction charge. The episode...

The writers of Katy Perry ’s song “Dark Horse,” who were found by a jury to have infringed on the copyright of Flame’s song “Joyful Noise” in a a $2.78 million decision this week, issued a statement today calling the decision a “travesty of justice.” “The writers of Dark Horse view the verdicts as a travesty of justice,” the statement reads. “There is no infringement. There was no access of substantial similarity. The only thing in common is unprotectable expression — evenly spaced “C and “B” notes — repeated. People including musicologists from all over are expressing their dismay over this....

Lawyer X hearing told Nicola Gobbo's dealings with Victoria Police were 'a disaster for her' Updated August 01, 2019 21:42:58 A former police officer who helped register gangland lawyer Nicola Gobbo as an informer has denied he endangered her life by pressuring her to inform on clients such as Tony Mokbel. The Lawyer X royal commission heard parts of a secretly recorded conversation in September 2005 when two police officers were assessing Ms Gobbo's suitability as a source. Ms Gobbo told the officers she was living in fear of Mokbel and his associates. At one point, an officer suggested to Ms Gobbo if she continued to work with the Mokbels it could only end in one of two...

Katy Perry might need to start filling up a new piggy bank: Yesterday, a Los Angeles jury ruled that her 2013 song "Dark Horse" copied "Joyful Noise," a 2008 hit by Christian rapper Flame, meaning the singer will have to pay damages. As Billboard reports, Katy isn't the only one the court found liable: collaborators Dr. Luke, Max Martin, and writer Sarah Hudson will also have to pay up, as will Juicy J, who features on "Dark Horse." Yikes! Flame, real name Marcus Gray, sued Katy in 2014, alongside his co-writers Emanuel Lambert and Chike Ojukwu. According to the Guardian, Katy and team said they'd never heard "Joyful Noise"—but Flame's lawyers pointed out that the song has millions of...

AVOIDING NEGLIGENCE CLAIMS IN LITIGATION 3: 10 MYTHS ABOUT LIMITATION THAT EVERY PERSONAL INJURY LAWYER SHOULD KNOW Here we look at ten “myths” (that is misconceptions) about limitation that can lead to personal injury litigators getting into difficulties. Myth 1: In a breach of contract case the limitation period is six years. This is clearly a prevalent belief. In David Bond –v- Livingstone & Co [2001] PNLR 30.the claimant suffered injuries in a clinic which was designed to cure baldness. Because this was a claim in contract the claimant’s solicitors believed (supported by the advice of two counsel) that there was a six year limitation period in contract. The original...
