Jargonbuster - Chambers Student Guide

Learn to distinguish between legal jargon which actually means something and meaningless business guff. ABS – alternative business structures: newly permitted arrangements for law firms, which allow non-lawyers to have a financial stake in the business. Adjudication – the legal process by which an arbiter or judge reviews evidence to come to a decision. Agency work – making a court appearance for another firm that can’t get to court. AIM – a ‘junior’ stock market run by the London Stock Exchange, which allows smaller companies to float stock within a more flexible system. Barristers

Barristers Information A barrister (also called "counsel") is a type of lawyer who specialises in court advocacy and the giving of legal opinion. To become a barrister, you must pass the exams set by the Kings Inns. (The Kings Inns is the body which governs entry to the profession of barrister-at-law in Ireland). After you have passed your exams, you must be "called to the Bar" and you must complete a year of "devilling", which is a form of apprenticeship for barristers. Barristers must wear white collars and a black gown in most courts. They may also wear a wig. In certain courts, such as the family law courts and the children's court, barristers do not wear the wig and gown. Barristers...

SCOTUS for law students: What does the Solicitor General do? (sponsored by Bloomberg Law) - SCOTUSblog

After the oral arguments in the health care cases in March, much attention was focused on the oral advocacy by Solicitor General Donald Verrilli. But who, exactly, is the Solicitor General and what does his office do? In simplest terms, the Solicitor General is the federal government’s lawyer in the Supreme Court. But there is much more to the role; in particular, the job requires the Solicitor General to strike a sometimes delicate balance between serving the legal interests of his superiors (the President and Attorney General), the long-term interests of the United States (as opposed to the present Administration), and his responsibility as a special officer of the Court itself. The...

What’s in a name?, Hong Kong Lawyer

As lawyers, we have a duty to ensure on behalf of our clients that the language used is appropriate so that it serves to convey the correct meaning and reflect the true intention. However, being selfless lawyers, we are good at taking care of our clients but not ourselves. Some of the traditional terms currently in use by the legal profession do not reflect the true meaning. "What’s in a name? That which we call a rose, By any other name would smell as sweet” (Shakespeare’s Romeo and Juliet) I agree that what matters is what something is, not what it is called. However, it always puzzles me why a qualified solicitor is commonly called an ‘assistant solicitor’ as if he or she is not yet...

Limited-Scope Representation - getting_started_selfhelp

Limited-scope representation is when you and a lawyer agree that the lawyer will handle some parts of your case and you will handle others. This is different from more traditional arrangements between lawyers and clients where a lawyer is hired to provide legal services on all aspects of a case, from start to finish. Limited-scope representation is sometimes called “unbundling” or “discrete task representation.” Here are some examples of limited-scope arrangements: You can just consult a lawyer and get legal information and advice about your case when you need it. You can hire the lawyer to represent you on certain issues in your case (like child support or custody) while you do the rest...
