However, after releasing a statement denouncing his arrest, the opposition MDC revealed that Advocate Mpofu was being moved to Rhodesville Police Station where he will be detained. He has since been charged with ‘Defeating or obstructing the course of justice’. The police alleged that he filed a court application at the Constitutional Court on behalf of his client using an affidavit filed by a “fictitious person”. Allegations are that it was a second application after the first one filed had failed.

Advocate Thabani Mpofu Arrested, His Warned and Cautioned Statement.
Advocate Mpofu’s arrest comes a few days after law expert and former advisor to the late Prime Minister Morgan Tsvangirai, sensationally claimed that he had learned of plans to arrest Mpofu on trumped-up charges. Writing on social media, Magaisa said,
I’m advised elements of the system are coming after top lawyer, Adv. Thabani Mpofu. The plan is to arrest him on some trumped-up charges.
Adv. Mpofu has been a prominent counsel for the opposition MDC A. It’s part of a relentless campaign to decimate the opposition & its pillars.
While Mpofu is a celebrated lawyer who is known for his acumen and eloquence, he achieved massive popularity when he represented Nelson Chamisa and the opposition at the Constitutional Court in 2018. Despite the fact that Nelson Chamisa lost the case, Thabani Mpofu won the hearts of many. He has continued representing the opposition and has been affectionately nicknamed the ‘people’s advocate.’
