This article addresses the contingent attorney fee – by far the most common type of personal injury lawyer fee arrangement for personal injury and workers’ compensation cases. Additionally, we will discuss how a settlement number is the first step in determining what you actually receive after a case. What Is a Contingency Fee? A contingent fee is an agreement where the client pays for the lawyer’s services at the end of the representation. Virtually all personal injury and workers’ compensation attorneys operate on the contingent fee basis. This means that no matter which...

Can your spouse be required to pay your attorney fees under Illinois law? DuPage County Divorce Lawyer Blog November 14, 2016

In Illinois, during a divorce, either party can ask the court to order the other party to pay some or all of his or her attorney fees while the case is pending. Section 501(c-1) of the Illinois Marriage and Dissolution of Marriage Act provides in pre-judgment (pre-decree) divorce cases, the court can assess attorney fees in favor of the petitioning party and against the other party. The purpose of these interim attorney fee awards is to “level the playing field” and allow an economically disadvantaged spouse to participate adequately in the litigation. See, Marriage of Rosenbaum-Golden. This may be necessary where one spouse uses his or her greater control of assets or income as a...

Why Capping Hourly Fees is Usually a Bad Idea, Lawyerist

Why Capping Hourly Fees is Usually a Bad Idea As flat fees become more popular, one of the ways lawyers often “try out” flat fees is by offering to cap their hourly fees. For example, a lawyer might offer to bill $200 per hour for a small lawsuit, but no more than $10,000, total. This is a rookie mistake. If the lawyer bills 50 or fewer hours, he will merely be paid for his work the same as if there were no cap on fees. But if he bills more than 50 hours, he gets the short end of the stick. Contrast this with a true flat fee where the lawyer charges $10,000 whether she spends 10, 50 or 100 hours on the representation. If she spends only 10 hours, she has come out ahead. If she...

Attorneys Fees in Class Action Lawsuits Trial Lawyer Money

Class-action lawsuits are created to protect consumers who were in some way defrauded out of money from some company that was providing products or services (or were believed to be). A small team of lawyers stand in court representing the interests of thousands or millions of consumers to achieve a win in the millions of dollars, which of course is supposed to be distributed to all members of the class that brought the lawsuit. After months or even years of billable hours working this case through, and the win is finally achieved, how do the attorneys get paid at the end? A recent study found that attorneys get paid the lion’s share of class-action money, from as little as 85 percent of...

Lawyer s fees for disability claims, Stateside Legal

Lawyer's fees for disability claims First off, I just want to say thank you for all of your hard work and dedication to veteran’s everywhere! I have a question pertaining to private attorneys and veteran’s disability law. Is there a legal cap to what a lawyer can be paid from retroactive disability claims? I know the cap for SSDI claims is $6,000 or 25% whichever is cheaper, but I’m having a hard time finding a definitive answer about veteran’s claims and caps. Please assist if you can and thank you again for your ongoing service! VA sets the fee at a standard 20% of any retroactive dollars awarded. That fee is strict with few exceptions. Attorneys who have incurred travel expenses...

NetNewsLedger - What Will It Cost Me To Hire A Criminal Lawyer In Toronto?

TORONTO – LEGAL – Whether you are guilty or not, if you are accused of a crime in Toronto, it is imperative that you find a local professional to defend you in court. The problem is that hiring a criminal lawyer is not an inexpensive proposition. While it’s necessary, unfortunately not all people accused of crimes have a limitless budget to hire a defense attorney. Federal Judge Rejects $1M Lawyer Fees in $125K Bad Faith Case

A lawyer’s request for more than $1 million in attorneys’ fees was rejected by a federal judge in Pennsylvania. The plaintiff was awarded $100,000 in punitive damages by the jury. While the award was appealed, the lead plaintiff counsel, Michael Pisanchyn, filed a bill of costs that amounted to well over $1 million in attorneys’ fees, interest and costs. Plaintiff’s counsel detailed the billing as follows: $48,050 for the underinsured motorist (UIM) claims, $827,515 on the bad...

Do You Know How to Pay Your Lawyer?, Law Office of J. Thomas Black, P.C.

It can be costly to file bankruptcy, but the most important thing to look at when faced with filing is the total amount of debt you are facing. Compared to the amount of debt that you can discharge, cancel, and not have to pay by filing bankruptcy, the attorney fees for filing bankruptcy is a small expense. In most of our cases, we charge reasonable fixed fees, which includes all of the services you may need to complete your Houston bankruptcy case. We find that most people like our fixed fees instead of hourly fees that many lawyers charge. The trouble with hourly fees is that they are based on how long it takes the lawyer to do the work and can have no upper limit. And people do not like...
